Terms of Service

This Agreement sets forth the terms and conditions that govern your use of the app and services offered by Glacier. ("Glacier App," "we," "us," or "our"). Your use of any of our services constitutes acceptance of this Agreement.

PLEASE READ CAREFULLY BEFORE USING GLACIER. YOUR USE OF THE SERVICE IS SUBJECT TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE GLACIER IN ANY WAY OR FOR ANY PURPOSE.

These Terms are accepted by you when you use Glacier. These Terms remain effective from the date of acceptance until terminated by you or Glacier in accordance with this Agreement.

You may not accept these Terms if: (a) you are not lawfully entitled to use the Service under any applicable laws in the country in which you are located or resident; or (b) you are not of legal age to form a binding agreement. By accepting these Terms, you acknowledge that you have reached the legal age to enter into a binding agreement in your jurisdiction, or that you have obtained the permission of a parent or legal guardian where required by applicable law.

Right to Refuse Service

Glacier reserves the right to refuse service to anyone, at any time, for any reason, including but not limited to: using the app for unintended purposes, using an unreasonable amount of resources, or abuse of these Terms, as determined solely by Glacier at our discretion.

Payment & Refunds

Glacier's services are provided on a paid subscription basis through the Apple App Store or the Glacier App site. Subscription rates are listed in the app and on the respective app stores. Glacier reserves the right to modify its rates at any time and/or to offer promotional pricing. Glacier does not process payments or issue refunds directly; all billing, invoicing, and refund requests are handled by the applicable app store. If you have a billing dispute, you must contact the app store to seek a remedy.

Modifications to Service and Terms

We may from time to time introduce new features, modify existing features, or discontinue features of the Service. We may also update these Terms at any time. Any modified Terms become effective upon posting. Your continued use of the Service following the posting of modified Terms constitutes your acceptance of those changes.

Cancellation

You may discontinue service at any time by canceling your subscription through the applicable app store. You will not be entitled to any refund of unused balances upon cancellation. You remain responsible for payment of all charges for services rendered through the date of cancellation.

Acceptable Use

You may not use Glacier to engage in any activity that is unlawful, harmful, or interferes with the operation of the Service. Without limiting the foregoing, you may not:

Use the Service to violate any applicable law or regulation.

Attempt to reverse-engineer, decompile, or disassemble any portion of the app or its infrastructure.

Use any automated means to access, scrape, or monitor the Service.

Resell, redistribute, or sublicense any portion of the Service.

Interfere with or disrupt the integrity or performance of the Service.

Limited License

We grant you a limited, non-sublicensable, non-exclusive, and revocable license to access and use Glacier solely in accordance with these Terms. All rights not expressly granted herein are reserved by Glacier.

Intellectual Property

All content, trademarks, logos, and intellectual property associated with Glacier are the property of Glacier Security, Inc. Nothing in these Terms grants you any right to use Glacier's name, trademarks, or branding without prior written consent.

Termination

Without limiting other remedies, Glacier may suspend or terminate this Agreement, or suspend or terminate your use of the Service, at any time if: (a) you are in breach of these Terms; (b) you are engaged in unlawful activity or infringe upon the rights of any third party; (c) required by applicable law or regulation; (d) you are using Glacier in a manner not originally intended; or (e) we decide to cease offering the Service.

Upon termination: (a) all licenses and rights to use the Service immediately terminate; and (b) you will immediately cease all use of the Service. Any obligations that by their nature are intended to survive termination shall survive.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND USED AT YOUR SOLE RISK. GLACIER MAKES NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. GLACIER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLACIER SHALL HAVE NO LIABILITY WHATSOEVER — WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER THEORY OF LIABILITY — ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICE. IN NO EVENT SHALL GLACIER BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF INCOME, BUSINESS, PROFITS, GOODWILL, OR DATA. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO CEASE USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold Glacier harmless from and against all damages, liability, loss, costs, and expenses (including reasonable legal fees) arising from: your breach of these Terms; your violation of any applicable law or regulation; or your infringement of the rights of any third party.

We are committed to respecting your privacy and the confidentiality of your personal information. Please review our Privacy Policy before using the Service.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Tennessee, without regard to conflict of laws provisions. The exclusive jurisdiction and venue for any action arising under these Terms shall be the federal and state courts located in Michigan, and each party waives any objection to jurisdiction and venue in such courts.

Miscellaneous

If any provision of these Terms is found by a court of competent jurisdiction to be illegal, invalid, or unenforceable, that provision shall be severed without affecting the enforceability of the remaining Terms.

The failure by Glacier to exercise or delay in exercising any right or remedy under these Terms shall not constitute a waiver of that right or remedy.

These Terms were drafted in English (US). In the event of any inconsistency between a translated version and the English version, the English version shall prevail.

BY CONTINUING TO USE THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND BY THEM.
